In the event that these International Order Terms and Conditions conflict with other terms and conditions set by the merchant in relation to an International Order, these International Order Terms and Conditions shall apply.
CrossTerra is the Seller of the Goods.
Each merchant that has provided goods for sale pursuant to these terms has partnered with CrossTerra Inc. ("CrossTerra" or "We") as a provider to process and facilitate orders placed on this website which are to be shipped to an address outside the United States ("International Orders"). When completing your purchase, you will be providing your payment details, shipping address and any additional information required to complete your order directly to CrossTerra, and not to the merchant.
Details regarding each product you are purchasing can be found on such product's detail page on the website.
Once your order has been approved, CrossTerra will assume title to the goods you have ordered for purpose of fulfilling your International Order. Any payment associated with an International Order will be processed and accepted directly by CrossTerra, as the seller of the goods to you ("Merchant of Record").
Once the payment is processed, title in the goods will shift to you. CrossTerra will then direct shipment of the goods by common carrier for delivery to the address indicated in your International Order. If you elect to use a payment card or other electronic form of payment for purchase of your International Order, the charges to your account will be accompanied by a descriptor referencing CrossTerra and/or the merchant.
Goods purchased are for personal use and may not be purchased for resale.
CrossTerra's Privacy Policy, which applies to CrossTerra's collection, use, disclosure and other processing of personal information, is located in our Privacy Policy. You consent to the personal and other information that CrossTerra may obtain about you being collected, stored and otherwise processed in accordance with the terms of the Privacy Policy.
In some jurisdictions, CrossTerra utilizes contracted third parties under strict confidentiality and data protection requirements for purposes of payment processing services. Such third parties have their own privacy policies and CrossTerra uses reasonable efforts to require each such third party to abide by its privacy policy.
All payments collected in relation to International Orders will be processed on the CrossTerra payments system. At checkout, you may select your preferred currency and payment method from those listed as available currencies and payment methods.
CrossTerra will present the purchase price to you in your preferred currency. Please note that prices in different countries and currencies may vary. When you complete and confirm payment, you are indicating that you agree and accept the presented price as the purchase price.
Where it is required by law, rule or regulation, or where you elect to pre-pay any applicable duties and taxes, CrossTerra will collect any such duties and taxes with your payment and make payment to the appropriate taxing authority on your behalf. When CrossTerra receives your payment details and any additional information related to your International Order, you hereby acknowledge and agree that CrossTerra is entitled to verify and authenticate your payment information, and if it is unable to verify this information, a CrossTerra representative may contact you and/or your payment card issuer to confirm your identity and/or your intent to place the order.
You are responsible for payment of the estimated value of any import taxes, sales tax, value added tax, and customs duties that may be levied by any government authority, and any disbursement fees, advancement fees or similar fees that may be imposed by the shipper, broker, the customs authority of the destination country or other party, including any additional penalties or fees imposed by applicable tax or customs authorities (collectively, "Duties, Taxes and Fees"). CrossTerra shall be liable for any difference in the estimated Duties, Taxes and Fees and the actual Duties, Taxes and Fees due and payable upon entry to the destination country.
You will never be asked to pay additional Duties, Taxes and Fees after checkout, nor will you be entitled to receive a refund of any portion of the estimated Duties, Taxes and Fees.
You may direct any inquiries, questions or comments regarding the goods you have purchased—including returns and refunds—to the merchant at our customer service center. We will be happy to assist and we will coordinate with the merchant as needed to address your concerns. Response times will vary, depending on the volume of inquiries, but we will endeavor to respond to you within five business days during normal business hours (in New York).
Subject to Local Law, CrossTerra's standard return policy is that we do not accept returns. If the merchant has a return policy that allows for international returns, CrossTerra may extend the merchant's return policy to its consumers as well. Your rights to revoke or cancel your International Order or for refunds if the goods do not conform to the product details at the time of purchase shall be governed by these Terms, unless otherwise required by Local Law. "Local Law" means the laws applicable to the online, ecommerce sale of consumer goods in the jurisdiction for which the sale of such goods was intended.
CrossTerra has no obligation to process the payment for your International Order until the International Order has been accepted, and CrossTerra reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in its sole discretion.
For your protection, CrossTerra utilizes various fraud prevention protocols and industry standard verification systems to reduce fraud. As a condition of accepting your International Order, you must comply with such protocols and business risk policies, including but not limited to card authentication and "ship to" and "bill to" address verification. Once an order is placed, you may not change payment information or any "ship to"/"bill to" address. If a request for an International Order is declined by CrossTerra or the merchant but payment is processed due to an error in the CrossTerra payment system, that transaction shall be void and any payment provided will be refunded.
In the event that any items in your International Order are shipped separately or at different times, or in the event that your International Order is partially filled, you will only be charged for the goods actually shipped to you, including any shipping fees, duties, taxes, VAT and/or other fees applicable to those goods.
You hereby authorize a licensed customs broker chosen by CrossTerra to act as your agent in working with foreign customs and revenue authorities to arrange for clearance of your International Order, and settle any duties and taxes on your behalf, if applicable. You hereby grant a proxy or power of attorney ("POA") to any common carrier or broker designated by CrossTerra authorizing the assigned customs broker or agent to act on your behalf. You agree and acknowledge that you are the Importer of Record, and acknowledge that the granting of the POA is a reasonable condition of service provided by CrossTerra and its designated carrier, broker or agent.
CROSSTERRA PROVIDES THE CROSSTERRA PAYMENT SYSTEM ON AN "AS IS" AND "AS AVAILABLE" BASIS. CROSSTERRA HAS NO LIABILITY FOR ANY SYSTEM UNAVAILABILITY OR INTERRUPTION. CROSSTERRA MAKES NO REPRESENTATIONS OR WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, AS TO THE GOODS PURCHASED, THE OPERATION OF THE CROSSTERRA PAYMENT SYSTEM, OR THE INFORMATION OR CONTENT DISPLAYED ON OR ACCESSIBLE VIA THE SYSTEM. YOU EXPRESSLY AGREE THAT YOUR USE OF THE CROSSTERRA PAYMENT SYSTEM IS SOLELY AT YOUR OWN RISK. CROSSTERRA DOES NOT WARRANT THE ACCURACY, RELIABILITY, OR COMPLETENESS OF ANY PRODUCT IMAGES, DESCRIPTIONS OR SPECIFICATIONS PROVIDED AT THE MERCHANT'S WEBSITE(S).

You acknowledge and agree that the merchant and CrossTerra reserve their respective rights to analyze transactional data, anonymously and in aggregate, for the purpose of identifying trends, statistics and measurements that could contribute to the enhancement of the merchant customer experience and/or the CrossTerra services. Any transactional data so analyzed will be aggregated and de-identified, such that any personally identifiable information is removed.
By agreeing to these Terms of Service, you certify that any goods purchased in an International Order will not be exported, sold, or transferred in violation of any applicable laws, including without limitation the U.S. Export Administration Regulations or applicable U.S. sanctions and embargoes administered by the U.S. Treasury Department. By purchasing such products you are acknowledging that the delivery of the goods purchased pursuant to the International Order does not violate any laws or regulations in the country of delivery, and you acknowledge and agree that it is your responsibility to know the laws in the country into which you are importing such products.
When you place an International Order, you are communicating with CrossTerra electronically, and acknowledge and agree to enter into your purchase agreement by electronic means, and to receive communications from CrossTerra electronically via email.
You acknowledge and agree that the merchant and CrossTerra each reserve the right to make changes to its systems, policies, and these International Order Terms and Conditions at any time. If any or any portion of these International Order Terms and Conditions shall be deemed invalid, void, or for any reason unenforceable, that term or portion of terms shall be deemed severable, and shall not affect the validity and enforceability of the remainder.
We will not be liable or responsible to you, nor be deemed to have defaulted or breached these Terms, for any failure or delay in our performance under these Terms when and to the extent such failure or delay is caused by or results from acts or circumstances beyond our reasonable control, including, without limitation, acts of God, flood, fire, earthquake, explosion, governmental actions, war, invasion or hostilities (whether war is declared or not), terrorist threats or acts, riot or other civil unrest, national emergency, revolution, insurrection, epidemic, lockouts, strikes or other labor disputes (whether or not relating to our workforce), or restraints or delays affecting carriers or inability or delay in obtaining supplies of adequate or suitable materials, materials or telecommunication breakdown or power outage.
This Site is operated from the US. All matters arising out of or relating to these Terms are governed by and construed in accordance with the internal laws of the State of New York without giving effect to any choice or conflict of law provision or rule (whether of the State of New York or any other jurisdiction) that would cause the application of the laws of any jurisdiction other than those of the State of New York.
The Local Law in Mexico includes Section 5.2 of Mexican Standard NMX-COE-001-SCFI-2018.
If any provision of these Terms is invalid, illegal, void, or unenforceable, then that provision will be deemed severed from these Terms and will not affect the validity or enforceability of the remaining provisions of these Terms.
